TERMS OF USE

Effective Date: July 1, 2026

Welcome to theBLOC Creative Campus ("theBLOC", "we", "our", or "us"). These Terms of Use govern your use of our facilities, memberships, website, booking platform, equipment, studios, shared spaces, and services.

By booking a space, purchasing a membership, attending an event, entering our facilities, or using any service provided by theBLOC, you agree to these Terms.

1. ELIGIBILITY

You must be at least 18 years of age, or have the written consent of a parent or legal guardian where approved by theBLOC, to create an account, purchase a membership, book a space, or use theBLOC.

Guests must be 18 years of age or older unless otherwise approved by management in advance.

You agree to provide accurate information when creating an account, purchasing a membership, making bookings, or entering the facility.

2. SERVICES

theBLOC provides access to creative spaces and services including, but not limited to:

- Film studios

- Recording studios

- Photography studios

- Rehearsal rooms

- Flex rooms

- Event spaces

- Meeting rooms

- Shared community areas

- Equipment rentals

- Creative memberships

- Educational programs

- Workshops

- Events

Availability of any space, service, room, equipment, program, or membership benefit is not guaranteed and may change without notice.

3. BOOKINGS

All bookings are subject to availability.

Bookings are confirmed only after payment has been successfully processed, unless otherwise approved in writing by theBLOC.

theBLOC reserves the right to refuse, modify, or cancel any booking for operational, safety, staffing, technical, maintenance, emergency, or policy reasons.

Booking time includes setup, teardown, reset, cleaning, and load-out unless otherwise approved. Users must exit the room by the end of their scheduled reservation.

Late checkout, overtime, or continued use beyond the scheduled reservation may be charged at the standard hourly booking rate for the applicable room, plus any additional staffing, cleaning, repair, or operational costs where applicable.

4. PAYMENTS

All prices are listed in Canadian Dollars (CAD).

Payment may be collected through our online booking platform or other approved payment methods.

Late or failed payments may result in cancellation of bookings, loss of access, or suspension of memberships.

If a scheduled membership payment fails, membership access may be paused until payment is successfully completed and any outstanding balance is resolved.

All applicable taxes will be added where required.

5. MEMBERSHIPS

Membership benefits are subject to availability and may change over time.

Memberships provide access to participating spaces during booked times only.

Memberships do not guarantee exclusive access to any room, studio, equipment, or shared area.

Members must reserve spaces through the official booking system.

Memberships are non-transferable unless expressly approved by theBLOC.

Memberships are intended for active creative use of the campus. Access may be reviewed, limited, suspended, or terminated if use becomes disruptive, excessive, unsafe, or outside the intended purpose of the membership.

6. INTRODUCTORY + BETA MEMBERSHIPS

theBLOC may offer different membership types, including Introductory Memberships, Beta Memberships, and future standard memberships. Each membership type has its own access, booking priority, booking limits, and included benefits.

Introductory Memberships include:

- No priority bookings.

- One booking per week, up to a maximum of 3 hours per week.

- Workshops are not included unless otherwise stated in writing.

- Introductory Memberships are available for a maximum of 3 months.

Beta Memberships are available until September 30, 2026 and include:

- Priority booking access, subject to availability.

- Unlimited pre-booked sessions during operating hours, subject to availability, room capacity, access policies, and the intended use of the campus.

- Booking limits, access policies, and membership benefits may evolve during the beta period.

- Feedback may be requested from members to help theBLOC evaluate facility usage and improve future membership offerings.

- Pricing may differ from future memberships.

The beta period is being used to help theBLOC understand real facility usage and shape future membership structures. Future standard membership pricing, access limits, renewal terms, and booking policies will be communicated when finalized.

Unless otherwise stated in writing, Introductory and Beta Memberships do not automatically renew into a future membership plan. Continued membership after the introductory or beta period may require acceptance of updated pricing, membership terms, and facility rules.

Members may cancel future renewals or membership continuation at any time before their next billing date, where applicable.

7. RESIDENT STUDIO TERMS

Resident studios are subject to separate approval, pricing, access terms, and studio-use expectations. A resident studio agreement, lease, or written approval may be required before a resident studio is occupied or used.

Resident studio agreements, leases, or written approvals are intended to work together with these Terms. Resident studio users must comply with both these Terms and any applicable resident studio agreement, lease, posted rule, or written approval.

Where a resident studio agreement contains additional or more specific requirements for that studio, those requirements also apply. Any conflict between these Terms and a resident studio agreement should be reviewed by theBLOC and resolved in writing.

Resident studio users are responsible for maintaining their studio in a clean, safe, professional, and respectful condition. Resident access does not provide unrestricted access to all rooms, equipment, shared spaces, storage areas, venue spaces, production zones, or staff-only areas.

Resident studio users may not modify, paint, build into, install fixtures, alter electrical systems, mount equipment, change locks, store hazardous materials, or make structural changes without approval from theBLOC.

Resident studio users are responsible for their guests, collaborators, clients, equipment, personal property, and any damage, disruption, or policy violation connected to their studio use.

Move-in, move-out, storage, signage, keys, access codes, after-hours use, insurance requirements, and termination terms may be outlined separately and must be followed as a condition of continued access.

8. PROFESSIONAL USE STANDARD

theBLOC is a working creative campus. Members, renters, residents, guests, collaborators, contractors, and attendees are expected to use the facility in a way that respects the work, privacy, safety, and experience of others.

Access may be reviewed, limited, suspended, or terminated if a user repeatedly disrupts the environment, misuses rooms or equipment, disregards staff direction, interferes with another user's work, or operates outside the intended use of the campus.

A shared creative campus only works when every user understands that one person's session can disrupt someone else's take.

9. ACCESS

Members and renters may only access bookable spaces during their scheduled reservation, unless otherwise approved.

Unauthorized access to restricted areas is prohibited.

Sharing access credentials, door codes, keys, membership privileges, or booking privileges is prohibited.

Guests remain the responsibility of the member, renter, or resident who invited them.

Users may not prop open secure doors, disable access systems, bypass check-in processes, or allow unauthorized individuals into the facility.

10. GUESTS

Guests, collaborators, clients, assistants, models, crew members, and visitors must be 18 years of age or older unless otherwise approved by management in advance.

Guests must follow these Terms, the KEC Code of Conduct, and any posted facility rules.

The member, renter, or resident who brings a guest is responsible for that guest's conduct, safety, access, cleanup, and any damage or disruption caused by the guest.

Guests may not be left unattended, use equipment, enter restricted areas, or access rooms outside the approved booking unless authorized by theBLOC.

theBLOC may limit guest numbers, require sign-in, request identification, or refuse guest access for safety, capacity, operational, or policy reasons.

11. LOITERING + SHARED CAMPUS PRESENCE

theBLOC is designed to be a creative campus where members can work, connect, gather, and build community. Members are welcome to spend time in approved shared areas when doing so does not disrupt other users, staff, sessions, bookings, or operations.

Shared areas are not intended for excessive hanging out, unapproved gatherings, sleeping, intoxication, storage, or activity that interferes with others. theBLOC may ask users or guests to relocate, quiet down, leave, or adjust their use of the space if their presence becomes disruptive or extends beyond a reasonable use of the campus.

12. NOISE, SOUND BLEED + SHARED-BUILDING ETIQUETTE

Users must manage sound levels in a way that respects neighbouring rooms, active sessions, common areas, staff offices, and other building users.

This includes monitoring playback volume, live instruments, amps, speakers, hallway noise, guest noise, rehearsal volume, and conversations near active studio rooms.

Quiet zones may be required during filming, podcasting, streaming, recording, interviews, photo shoots, rehearsals, or other active sessions. Users must follow staff direction and posted signage related to quiet zones, sound levels, and room use.

Users may not interrupt, enter, record, observe, or disrupt another user's active session without permission. Hallways, shared areas, and common spaces should be used with awareness that sound can travel and affect other creative work.

Repeated noise complaints, sound bleed issues, or disruption to other sessions may result in volume limits, room changes, suspension of access, or additional staffing/technical requirements.

13. EQUIPMENT

Users are responsible for any equipment provided during their booking, rental, membership use, or resident studio access.

Equipment must be returned in the same condition it was received.

Damage beyond normal wear may result in repair, replacement, cleaning, or service charges.

Users may not modify, dismantle, rewire, patch, move, remove, loan, or take equipment from the premises without written permission.

Some equipment may require staff approval, training, supervised use, deposits, signed check-out, or additional fees. theBLOC may deny or revoke equipment access if a user is not trained, misuses equipment, creates safety risk, or fails to return equipment on time.

Users are responsible for loss, theft, damage, misuse, missing accessories, late returns, or unauthorized use of equipment connected to their booking, membership, resident studio, guests, or collaborators.

14. STUDIO-SPECIFIC CONDUCT

Users must follow all posted room-specific rules and staff instructions. "Respect the space" includes using each studio for its intended purpose and leaving it ready for the next user.

Studio-specific expectations may include, but are not limited to:

- No food or drinks in restricted technical areas, studios, recording rooms, control rooms, cyclorama areas, or near equipment unless approved.

- Clean shoes before entering cyclorama or clean-floor areas.

- Use pads under gear, stands, props, furniture, and equipment in contact with studio floors.

- Do not drag equipment across floors, cyclorama surfaces, or painted areas.

- Do not tape, paint, mark, drill, hang, rig, modify, or attach anything to walls, floors, ceilings, cyclorama surfaces, fixtures, or equipment without approval.

- Do not unplug, reroute, repatch, reconfigure, reset, or change studio equipment, lighting, computers, interfaces, microphones, cameras, cables, presets, or installed systems without approval.

- Report scuffs, spills, damage, broken gear, missing items, unsafe conditions, or maintenance needs immediately.

- Reset the room, furniture, cables, equipment, props, and garbage before leaving.

Failure to follow studio-specific rules may result in cleaning fees, repair costs, restricted access, or suspension of use.

15. RESPECT FOR THE SPACE

All users agree to:

- Leave spaces clean and reset.

- Dispose of garbage, recycling, and personal items properly.

- Return furniture, equipment, cables, props, and shared items to their original locations.

- Respect other users, staff, neighbours, clients, artists, and collaborators.

- Follow posted capacity limits.

- Follow all safety instructions, posted rules, and staff direction.

Failure to do so may result in cleaning fees, repair charges, replacement costs, suspension of access, or termination of membership or booking privileges.

16. SAFETY, RESTRICTED AREAS + PRODUCTION ZONES

Users must follow all posted and communicated safety procedures. Restricted areas, staff-only areas, production zones, storage rooms, mechanical rooms, offices, rooftops, venue spaces, backstage areas, and technical areas are off limits unless specifically approved.

Users must keep exits, aisles, stairways, doorways, hallways, access points, fire equipment, loading paths, and emergency routes clear at all times.

Users may not block doors, prop secure doors, disable safety systems, move safety equipment, overload circuits, create trip hazards, or use equipment in a way that creates risk.

Hazards, spills, damage, unsafe behaviour, injuries, medical concerns, or security concerns must be reported immediately to theBLOC staff or the venue liaison on site.

17. CONFIDENTIALITY + PRIVACY INSIDE THE CAMPUS

Users may not photograph, film, record, share, livestream, publish, discuss, or disclose another member's work, session, client, equipment, creative materials, business information, unreleased content, or private activity without permission.

Users must respect closed doors, active sessions, private bookings, resident studios, client meetings, and creative work in progress.

Unreleased music, film, photography, scripts, designs, business plans, recordings, visuals, client work, and other creative materials encountered at theBLOC must be treated as confidential unless the owner has clearly made them public or given permission to share.

18. CONTENT CREATED

You retain ownership of the creative work you produce while using theBLOC.

You are responsible for securing any rights, permissions, releases, licenses, clearances, approvals, or consents required for the content you create, record, film, photograph, perform, publish, distribute, or monetize.

Users may not create, capture, or distribute content that is illegal, exploitative, hateful, harassing, non-consensual, unsafe, or in violation of these Terms.

Users may not film, photograph, record, or livestream staff, other users, guests, private sessions, resident studios, restricted areas, security systems, access codes, or behind-the-scenes operations without permission.

By entering public areas of the facility, you acknowledge that photographs or video may occasionally be captured by theBLOC for promotional purposes. If you do not wish to appear in promotional materials, notify staff before your visit.

19. FILES, STORAGE + DATA RESPONSIBILITY

Users are responsible for saving, exporting, backing up, and removing their own files, session data, recordings, footage, project files, exports, hard drives, memory cards, and creative assets before the end of their booking.

theBLOC is not responsible for lost, deleted, overwritten, corrupted, unsaved, or inaccessible files, media, data, recordings, footage, or creative materials.

Files left on shared computers, drives, equipment, cards, or systems may be deleted as part of regular maintenance, resets, or operational use.

20. PROHIBITED ACTIVITIES

The following are prohibited unless specifically approved:

- Illegal activity

- Smoking or vaping inside the building

- Alcohol service or consumption outside approved terms

- Open flames, candles, pyrotechnics, haze, fog, smoke effects, or atmospheric effects

- Hazardous materials

- Weapons

- Excessive noise or sound bleed outside booked spaces

- Harassment, discrimination, intimidation, threats, or violence

- Damage to property

- Unauthorized commercial sales

- Unauthorized filming, photography, recording, livestreaming, or publication of others

- Activities that interfere with other users, staff, residents, sessions, bookings, guests, or operations

theBLOC reserves the right to remove anyone violating these policies without refund.

21. CODE OF CONDUCT

All members, renters, residents, guests, collaborators, contractors, attendees, and visitors using theBLOC must follow the KEC Code of Conduct, as well as these Terms and any posted facility rules.

theBLOC reserves the right to remove, suspend, terminate, or refuse access to any individual or group whose conduct creates risk, disrupts operations, interferes with other users, damages the facility, or does not align with the professional standard of the campus.

22. LIABILITY

Participation in activities at theBLOC is at your own risk.

To the maximum extent permitted by law, theBLOC, Kelowna Events Centre, its employees, volunteers, contractors, directors, affiliates, and partners shall not be liable for:

- Personal injury

- Property damage

- Lost, stolen, or damaged items

- Business interruption

- Lost income

- Lost, corrupted, deleted, or unsaved files or data

- Indirect or consequential damages

Users are responsible for carrying any insurance they require for their activities, equipment, property, production, business, guests, clients, and creative work.

23. INSURANCE

theBLOC may require proof of insurance for certain uses, including resident studios, commercial productions, large crews, equipment rentals, events, public-facing activities, high-risk work, or uses involving clients, attendees, performers, contractors, alcohol, third-party vendors, or specialized equipment.

Failure to provide requested insurance documentation may result in cancellation, refusal of access, restricted use, or additional requirements.

24. INDEMNIFICATION

You agree to indemnify and hold harmless theBLOC, Kelowna Events Centre, its staff, volunteers, directors, contractors, affiliates, and partners from any claims, losses, damages, liabilities, costs, or legal expenses arising from your use of the facilities, your guests or collaborators, your content, your equipment, your activities, or your violation of these Terms.

25. CANCELLATION POLICY

Room-specific cancellation and rescheduling policies will be displayed at the time of booking or communicated through the booking platform, invoice, written confirmation, or applicable room-use terms.

Cancellation requirements may vary by room. For example, some rooms may require longer notice due to setup, staffing, technical preparation, or operational needs.

Unless required by law or approved by management in writing, all bookings, membership fees, and other payments are non-refundable once billed or processed.

Missed bookings, late arrivals, and unused booked time are considered used and are not eligible for refund or credit unless approved by management in writing.

theBLOC may cancel, reschedule, or modify bookings due to operational, safety, staffing, technical, maintenance, emergency, or policy reasons.

26. SUSPENSION OR TERMINATION

theBLOC may, at its sole discretion, immediately suspend, limit, revoke, or terminate access, bookings, membership privileges, resident studio access, or equipment use without refund if a user:

- Violates these Terms, the KEC Code of Conduct, posted rules, or staff direction

- Fails to pay outstanding balances

- Damages property or equipment

- Creates an unsafe environment

- Harasses, intimidates, threatens, or discriminates against staff, users, members, clients, guests, artists, or collaborators

- Uses the facilities for illegal purposes

- Disrupts other users, sessions, bookings, residents, staff, or operations

- Shares access codes, keys, credentials, equipment, or membership privileges without authorization

- Misuses resident studios, shared areas, equipment, or campus access

theBLOC is not required to provide a warning, cure period, appeal process, or opportunity to remedy before taking action where it determines that suspension or termination is appropriate.

theBLOC may choose to review a suspension or consider reinstatement at its discretion, but is not obligated to do so.

27. FORCE MAJEURE

theBLOC is not responsible for interruptions caused by circumstances beyond our reasonable control, including natural disasters, public emergencies, government orders, power outages, technical failures, staffing interruptions, building issues, or other unforeseen events.

28. PRIVACY

theBLOC collects personal information for the purpose of operating memberships, bookings, communications, billing, facility management, safety, security, and related administrative needs.

This may include your name, contact information, billing details, booking history, membership status, access records, and information required to support safe and professional use of the facility.

theBLOC will use this information only for reasonable business, operational, safety, and communication purposes connected to your use of theBLOC. Personal information will not be sold or shared for unrelated third-party marketing.

By using theBLOC, booking a space, purchasing a membership, or entering the facility, you acknowledge and consent to this collection and use of information.

29. CHANGES

theBLOC may amend these Terms of Use, membership policies, pricing, booking procedures, facility rules, or related operating documents from time to time to reflect operational, legal, safety, security, or business requirements.

Where a change materially affects members' rights, obligations, or use of the campus, theBLOC will provide at least 30 days' notice before the change takes effect, unless a shorter notice period is required by law or is necessary to protect the safety, security, or operation of the campus.

Notice may be provided by one or more of the following methods:

- Email to the address associated with the member's account

- Notification through the booking platform or member portal

- Posting on the official theBLOC or Kelowna Events Centre website

- Posting a notice within the campus

Minor administrative updates, corrections, or changes required by applicable law may take effect immediately upon publication.

A member's continued use of the campus or continued membership after the effective date of any revised Terms constitutes acceptance of those changes.

30. GOVERNING LAW

These Terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable therein.

Any disputes shall be resolved within the courts of British Columbia.
